Implementing the Pretrial Fairness Act: A Nuts and Bolts Guide

The many pretrial reforms referred to as the Pretrial Fairness Act (PFA) were passed via Public Act 101-0652, known as the SAFE-T Act (Safety, Accountability, Fairness and Equity-Today). The PFA, among other changes, abolishes the use of cash bail in pretrial release decisions on January 1, 2023 and establishes new processes for pretrial release and detention.In this CLE, we will discuss the key changes to the administration of pretrial justice pursuant to the PFA. We will also identify the key pretrial decision points and what the PFA says about decision making at each point of the process including: release with citation, release from custody, pre-initial appearance, initial appearance and release conditions, detention hearings, warrants and orders to show cause, and release modifications and revocations. All are welcome to join us and learn about the nuts and bolts of the PFA from this panel of justice system partners.
